I wish I knew for a fact that Capitol records didn't renew this copyright and none of those <a href="http://www.allmusic.com/cg/amg.dll?p=amg&token=&sql=33:eoue4jn70w2l">other 20 record companies</a> that have thrown this song into a compilation are paying any royalties. The original copyright would have expired in 1980 which makes most sense since it appears on a bunch of compilations starting in 1989. However, if Capitol records did extend the copyright and are requesting royalties they can continue to do so until 2047.

What does anyone else think?

They are illegal.

He's dead. we're alive. Therefore we must create.

We're not making money off this.

The worst case scenario is this site blows up and we receive a cease and desist order.

That's what happend to Dangermouse and now's he's an accpeted artist with near complete freedom.

I don't really expect to hear from any lawyers about this. People as individuals, like Dangermouse and yourself, do have 'near complete freedom' but we are trying to build a community here. And I am a lot more motivated to develop the site when I don't have shady practices to think about. It would suck to throw out an entire compo because just because of some sound.

If you therefore must create why don't you learn how to comp some chords and melody?

I don't understand how a sample could through out a compo or how can the compo ever be stopped?

In its current form there is no money exchange, therefore there is no infringement on business.

AM I wrong?

If we are trying to build a not-for-profit LLC we should observe professional practices. You are correct -- in it's current form there is no money exchange. But, in the future, if we are looking to distribute compo winners to help support BotB there could be money involved. But since we forget to clarify that that might happen to the people who are submitting tracks we might as well reduce ourselves to only ever being an underground movement.

The problem lays in that there are no set standards on copyright. The rules keep changing. New laws are added, and then overturned. In some countries its okay, in others its not. It is a quagmire of legalize.

There are no standardized rules or professional practices... that's the problem.

I agree with you that we don't want to *reduce ourselves* to an underground movement. However, I believe that *this is exactly what we are doing* by worrying about copyright infringement of every sample.

Obviously, we don't want to use stuff that is fresh/new and still in obvious copyright. I'm cool with the 50 years rule.

I think we should worry about infringment for distribution of BOTB tracks when we come to that fork in the road. We are far from there. Many producers create tracks with sampled works and pay for rights only after the copyright owner asks for $$$. ala the Amen break.

Example: I can't imagine the founders of dub reaggae stopping their production by saying, "Sorry Mon, we should stop making this music cuz we might get sued in the future. Now pass the dutchie on the left hand side." (not tyrying to compare you or I with founders of dub on social, political, or ethnic levels; only on a creative and economic ones)


Perhaps this is just a fundamental difference between you and I. To me, one of the greatest joys of listening to re-mixed music is hearing an old recognizable sample in a new creative way. It just hits at the core and makes me smile. If it weren't for the illegal use of samples, I and thousands of others would have never been exposed to all the great jazz, classical and what not that the samples came from. Samples are what connects us to our musical hertiage as human beings. It is a forum which has never existed before and should be taken advantage of; not scared away from.

Using all orginal samples and sounds almost defeats the porpose. If people want to create original tracks with original sounds, then what is the point of re-mixing?

I am in no way trying to attack anyone here, simply trying to voice my opinion.

I am still in this 100% with all my blood, sweat and tears. I am proud to incur the financial losses of the battles and am always in your debt.

The reasoning for your proposal is because no one wants to listen to sounds that aren't borrowed from somewhere you have already heard before? I am sorry. This perspective is all news to me. I'm not so sure how to take all of this. I mean, gosh and all. Maybe if you would have shown any interest in coming to any of BotB's development meetings way back in the day I could have been aware of such an ideology. How about supporting artists in your community now that are struggling to be heard? How many people are busting beats, spitting and serenading by lute in your town? Don't <i>you own</i> a saxophone? I admit much respect for prolific digging style but it isn't necessary. "Using all orginal samples and sounds almost defeats the porpoise." doesn't make much sense to me as every battle is given a certain variety of sounds and they resonate throughout every playa's remix track for that battle. Part of the battle is the sound file submission for which playa's are rewarded points by providing charismatic sound bits. Battle of the Bits. Maybe I'm just being dreamy that the samples will continue to evolve as more people get involved with BotB but if you are simply 'proud to incure financial losses' then I don't want your credit.
